Unlike many states, California does not offer diversionary programs for first time DUI offenders. Even if you have a clean driving record, you will face charges for drunk driving in court and if convicted, you will have to live with the consequences. In addition to fines and possible jail time, a DUI will impact your life in other ways as well:
- Alcohol classes: You will have to attend a three, six or nine month alcohol abuse class, based on your blood alcohol level. I will work to reduce the length of your class.
- Driving record: If you are charged with a DUI, the DMV will suspend your license. I can fight your license suspension and help you minimize the impact on your insurance.
In addition to protecting the rights of firs-time offenders, I also protect the rights of individuals who have prior drunk driving charges on their records.
DUI Enhancements
There are a number of factors that will impact the severity of the charges you face and the potential consequences. There are DUI enhancements for individuals with a blood alcohol content over .15 or .20. There are additional enhancements for individuals under the age of 21. If you were driving over thirty miles per hour above the posted speed limit while driving under the influence, you will face an additional sixty days of incarceration. Taking a close look at your case, I will look for any possible enhancements and see how they can be reduced.
